{"id":29253,"date":"2024-03-06T15:12:59","date_gmt":"2024-03-06T20:12:59","guid":{"rendered":"https:\/\/www.carh.org\/?p=29253"},"modified":"2024-03-06T16:57:03","modified_gmt":"2024-03-06T21:57:03","slug":"rd-unnumbered-letter-to-mfh-staff-re-hotma","status":"publish","type":"post","link":"https:\/\/www.carh.org\/rd-unnumbered-letter-to-mfh-staff-re-hotma\/","title":{"rendered":"RD Unnumbered Letter to MFH Staff Re Administrator Exception &#8211; Housing Opportunity Through Modernization Act Implementation"},"content":{"rendered":"<p>On March 4, 2024, RD issued an <a href=\"https:\/\/www.rd.usda.gov\/sites\/default\/files\/RDUL-Exception.pdf\" target=\"_blank\" rel=\"noopener\"><strong>Unnumbered Letter<\/strong><\/a> to provide notice to Multifamily Housing (MFH) staff of the Administrators Exception related to an upcoming regulation change resulting from the Housing Opportunity Through Modernization Act (HOTMA).<\/p>\n<p><em>On March 6, RD issued the following Stakeholder Announcement on the UL:<\/em><\/p>\n<p><strong>Washington D.C, March, 06, 2024<\/strong> &#8211;<span data-contrast=\"none\">The Rural Housing Service (RHS) Administrator approved an Administrator\u2019s Exception related to an upcoming regulation change resulting from the <\/span><strong><a href=\"https:\/\/www.congress.gov\/114\/plaws\/publ201\/PLAW-114publ201.pdf\" target=\"_blank\" rel=\"noopener\">Housing Opportunity Through Modernization Act<\/a><\/strong><span data-contrast=\"none\"> (HOTMA).<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">RHS published a <a href=\"https:\/\/www.rd.usda.gov\/media\/file\/download\/memorandum-sa-administrators-exception-signed2024-03-04.pdf\" target=\"_blank\" rel=\"noopener\"><strong>Memorandum<\/strong><\/a>, informing Multifamily Housing (MFH) owners, management agents, and partners of an Administrator\u2019s Exception as it relates to 7 CFR 3560.153 and 24 CFR 5.609(c).\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The Housing Act of 1949 requires the calculation of tenant\u2019s annual and adjusted household income be taken from the definition provided by the Housing Act of 1937 (42 USC 1471; 42 USC 1437a). This requirement is reflected in 7 CFR 3560.153(a) which requires annual and adjusted income to be calculated in accordance with <strong><a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/subtitle-A\/part-5\/subpart-F\/subject-group-ECFR174c6349abd095d\/section-5.609\" target=\"_blank\" rel=\"noopener\">24 CFR 5.609<\/a><\/strong>.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">HOTMA, signed into law on July 29, 2016, directed The U.S. Department of Housing and Urban Development (HUD) to issue a rule, making changes to the requirements related to income calculations found in the Housing Act of 1937.\u00a0 To incorporate the changes made by HOTMA, HUD published a Final Rule on February 14, 2023, updating the existing 24 CFR 5.609.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><strong><span data-contrast=\"none\">The Housing Act of 1949 does not incorporate the updates found in 24 CFR 5.609(c) and accordingly RHS and MFH will not implement 24 CFR 5.609(c)<\/span><\/strong><span data-contrast=\"none\">.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On March 4, 2024, RD issued an Unnumbered Letter to provide notice to Multifamily Housing (MFH) staff of the Administrators Exception related to an upcoming regulation change resulting from the Housing Opportunity Through Modernization Act (HOTMA).
