{"id":28084,"date":"2023-02-28T10:36:35","date_gmt":"2023-02-28T15:36:35","guid":{"rendered":"https:\/\/www.carh.org\/?p=28084"},"modified":"2023-02-28T10:36:35","modified_gmt":"2023-02-28T15:36:35","slug":"insurance-issues-and-deductibles-rural-development","status":"publish","type":"post","link":"https:\/\/www.carh.org\/insurance-issues-and-deductibles-rural-development\/","title":{"rendered":"Insurance Issues and Deductibles \u2013 Rural Development"},"content":{"rendered":"<p><strong>CARH\u2019S BROADCAST E-MAIL \u2013 Regulatory Update<\/p>\n<p><\/strong><strong>February 28, 2023<\/strong><\/p>\n<p>Over the last several months, CARH members have engaged in several robust discussions during national and state meetings regarding the impact of increased insurance rates on rural properties\u2019 operations. On <a href=\"http:\/\/www.carh.org\/wp-content\/uploads\/2023\/02\/CARH-Letter-to-Nancie-Ann-Bodell-Regarding-Waiver-of-Insurance-Deductible-Limits-and-Claims-Processing-12-20-22.pdf\" target=\"_blank\" rel=\"noopener\"><strong>December 20, 2022, <\/strong><\/a>CARH sent a letter to Rural Development (RD) outlining members\u2019 concerns and asking RD to change current policies and procedures.<\/p>\n<p>On February 23, 2023, Nancie-Ann Bodell, RD\u2019s Multifamily Housing Deputy Administer responded on behalf of RD. RD indicated in <a href=\"http:\/\/www.carh.org\/wp-content\/uploads\/2023\/02\/Insurance-Deductibles-and-Issues-Related-to-Claims-Processing-CARH-2023.02.23.pdf\" target=\"_blank\" rel=\"noopener\"><strong>the letter<\/strong><\/a> that they are drafting a proposed rule,\u00a0 expected to be published in June 2023. The proposed rule will align RD requirements with housing standards. Specifically, she states that, \u201cItems under consideration to include in the rule include (1) increased deductible limits based on a \u201cnot to exceed\u201d amount instead of the current formula calculation; and (2) updated insurance coverage requirements to the industry standard of a percent of replacement value.\u201d<\/p>\n<p>RD does address the deductible issue raised in CARH\u2019s original letter by stating owners may increase the deductible amount above the maximum amount required by the regulation, so long as the deductible amount above the maximum is deposited and maintained in the project reserve account. Regarding redundant bid requirements, RD indicates that where the insurance company approves a contractor to perform insurance funded repairs, RD agrees that the bid reserve account requirement is not applicable.<\/p>\n<p>RD will be training staff on these new procedures and will include stakeholders in the training session to ensure consistent compliance.
