{"id":28032,"date":"2023-02-14T15:47:58","date_gmt":"2023-02-14T20:47:58","guid":{"rendered":"https:\/\/www.carh.org\/?p=28032"},"modified":"2023-02-14T15:47:58","modified_gmt":"2023-02-14T20:47:58","slug":"hud-hotma-final-rule-available-important-changes-for-multifamily-owners-and-operators","status":"publish","type":"post","link":"https:\/\/www.carh.org\/hud-hotma-final-rule-available-important-changes-for-multifamily-owners-and-operators\/","title":{"rendered":"HUD:  HOTMA Final Rule Available &#8211; Important Changes for Multifamily Owners and Operators"},"content":{"rendered":"<p><em>The following information was sent to HUD&#8217;s Office of Multifamily Housing on February 14, 2023.\u00a0<\/em><\/p>\n<h3><strong>Dear Multifamily Owners and Program Operators,<span data-ccp-parastyle=\"heading 3\">\u202f\u00a0<\/span><\/strong><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:255,&quot;335559740&quot;:240}\">\u00a0<\/span><\/h3>\n<p>Today, the U.S. Department of Housing and Urban Development (HUD) published its <strong><a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/02\/14\/2023-01617\/housing-opportunity-through-modernization-act-of-2016-implementation-of-sections-102-103-and-104\" target=\"_blank\" rel=\"noopener\">final rule<\/a><\/strong>\u00a0in the <em>Federal Register<\/em> implementing the Housing Opportunity Through Modernization Act of 2016 (HOTMA). The official publication in the <em>Federal Register<\/em> follows HUD&#8217;s publication of a preview version on January 31, 2023.<\/p>\n<p>As communicated on January 31, the rule covers sections 102, 103, and 104 of HOTMA; only sections 102 and 104 apply to Multifamily Housing (MFH) programs. Specifically, these sections affect owners participating in the following programs: Section 8 Project-Based Rental Assistance (PBRA), Section 202 Housing for Low-Income Elderly, and Section 811 Housing for Low-Income Persons with Disabilities.<\/p>\n<p>This final rule is effective January 1, 2024. Owners may not implement these provisions prior to their effective dates.<\/p>\n<p><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:75,&quot;335559740&quot;:240}\">\u00a0<\/span><strong>Sections 102 and 104<\/strong><\/p>\n<p>The changes put into effect by sections 102 and 104 of HOTMA are described below:<\/p>\n<ul>\n<li>Section 102 addresses income reviews, making modifications to such things as the frequency of income reviews and the definitions of income and assets.<\/li>\n<li>Section 104 establishes an asset limitation for families assisted under the PBRA program while also implementing deductions and exceptions for certain investments, including retirement savings and modest increases in income.<\/li>\n<\/ul>\n<p>Updates to TRACs are under way and will be released prior to the effective dates of these provisions.<\/p>\n<h3><strong>HOTMA Resources for Multifamily Property Owners<\/strong><\/h3>\n<p>MFH has updated its HOTMA <strong><a href=\"https:\/\/www.hud.gov\/program_offices\/housing\/mfh\/hotma\" target=\"_blank\" rel=\"noopener\">Web page<\/a><\/strong> with information to assist MFH stakeholders in understanding the final rule.
